Prize Draw Terms and Conditions(the “Terms and Conditions”)
1. Promoters
1.1 These Terms and Conditions are overarching terms that apply to multiple prize draws made available through the JB5 app from time to time, unless stated otherwise in the relevant competition post. The joint promoters of each prize draw ("Prize Draw") are Blue Lights Digital Ltd and Bello & Bello Ltd (the “Promoters”). Blue Lights Digital Ltd is responsible for operating, administering and conducting each Prize Draw. Bello & Bello Ltd is responsible for the supply of the prize(s).
1.2 By entering the Prize Draw, entrants agree to be bound by these Terms and Conditions.
2. Eligibility
2.1 The Prize Draw is open worldwide in countries where the JB5 app is available and participation is permitted by law. The Prize Draw is void where prohibited or restricted by applicable laws or regulations.
2.2 Entrants under the age of 18 may enter only with the prior permission of a parent or legal guardian, who must agree to these Terms and Conditions on the entrant’s behalf. The Promoters may require evidence of such permission before awarding a prize and may decline to award a prize where satisfactory evidence is not provided. Certain prizes may not be available to entrants under the age of 18.
2.3 Employees, contractors, directors, officers and immediate family members of the Promoters, their affiliates, subsidiaries or anyone professionally associated with the administration of the Prize Draw are not eligible to enter.
2.4 The Promoters reserve the right to verify the eligibility of any entrant and may require proof of age, identity and residence before awarding a prize.
2.5 The Promoters may disqualify any entrant found to have provided false information or otherwise breached these Terms and Conditions.
3. Entry Requirements
3.1 To enter a Prize Draw, an entrant must:
Have a valid account within the application (including where you sign in using a valid Google Account or Apple ID);
Complete the entry requirements outlined in the relevant Prize Draw competition post within the JB5 app; and
Comply with these Terms and Conditions.
3.2 No purchase, payment or paid subscription is necessary to enter or win.
3.3 Only one entry per eligible person will be accepted unless otherwise stated in the competition post.
3.4 Entries submitted outside the stated entry period will not be eligible.
3.5 Entries will not be accepted by any other means than as listed above and the Prize Draw is free to enter.
3.6 The use of multiple accounts, automated systems, bots, scripts, fraudulent methods or any attempt to manipulate the Prize Draw is strictly prohibited and may result in disqualification.
4. Competition Period
4.1 Each Prize Draw will be posted in the JB5 app, and will specify the details applicable to that Prize Draw, including:
The prize(s) available;
The entry period, including the opening date and time, and the closing date and time;
How to enter; and
Any restrictions on entry, including any age, geographical, or other eligibility requirements.
4.2 Each Prize Draw will open when the relevant competition post is published on the JB5 app, unless a different opening date or time is specified in that post.
5. Prizes
5.1 Prize contents and value may vary between Prize Draws.
5.2 Prizes are non-transferable, non-refundable and cannot be exchanged for cash unless expressly stated otherwise by the Promoter.
5.3 The Promoters reserve the right to substitute any prize with another prize of equal or greater value where circumstances beyond their reasonable control make this necessary or where clause 8.2 applies. Any taxes, duties, customs charges or other costs arising from acceptance of a prize shall be the sole responsibility of the winner unless otherwise stated.
6. Winner Selection
6.1 Winners will be selected at random from all eligible entries received during the entry period.
6.2 The draw will take place within a reasonable period following the closing date.
6.3 The Promoters’ decision regarding all matters relating to the Prize Draw is final.
7. Winner Notification
7.1 Winners will be notified via email to the email address associated with their Google Account or Apple ID via an email sent from: giveaways@belloandbello.com.
7.2 Winners must respond within fourteen (14) days of notification unless a different period is specified in the competition post.
7.3 If a winner cannot be contacted, fails to respond within the required period, declines the prize, or is found to be ineligible, the Promoters reserve the right to select an alternative winner.
7.4 The surname and place of residence of the winner(s) may be made available upon request to demonstrate that a valid award has taken place. Any entrant may object to such disclosure, or request that the amount of personal information disclosed be reduced, by contacting the Promoters. In such circumstances, the Promoters may still provide the information to the Advertising Standards Authority on request.
8. Prize Fulfilment
8.1 Winners may be required to provide contact details, delivery address and any other information to the Promoters, or a third party appointed by the Promoters, solely for the purpose of prize fulfilment.
8.2 The Promoters reserve the right to refuse, cancel, or withhold shipment of any prize to such locations for legal, regulatory, sanctions, export control, tax, customs, logistical, or other operational reasons. If a prize cannot be delivered to a winner's location, the Promoters may, at their sole discretion, award an alternative prize of equal or greater value, or take such other steps as it considers appropriate to administer the Prize Draw in a fair and reasonable manner and in accordance with these Terms and Conditions.
9. Publicity
9.1 Any additional promotional activity, including imagery, involving a winner will require the winner's prior consent.
9.2 The Prize Draw, the JB5 app and all associated names, logos, trade marks, images, designs and other intellectual property rights, including the name, image, likeness and other rights of personality of Jude Bellingham, remain the property of their respective owners. Nothing in these Terms and Conditions grants any entrant or winner any right to use, reproduce or exploit any such intellectual property, save as expressly permitted in writing by the relevant owner.
10. Data Protection
10.1 Personal information provided in connection with the Prize Draw will be processed by the Promoters in accordance with the Promoter's Privacy Policy and applicable data protection laws.
10.2 Personal data will be used solely for administering the Prize Draw and fulfilling any prize.
11. Platform Disclaimer
11.1 Google LLC, Apple Inc. and their respective affiliates are not sponsors of, and are not responsible for, the administration of any Prize Draw.
11.2 By participating, entrants release Google LLC, Apple Inc. and their affiliates from any liability arising from the Prize Draw to the extent permitted by law.
12. Fraud, Abuse and Disqualification
12.1 The Promoters reserve the right to disqualify any entrant who:
Breaches these Terms and Conditions;
Uses fraudulent or deceptive methods;
Creates multiple accounts to gain an unfair advantage;
Uses automated systems or bots;
In the Promoters’ sole opinion, has otherwise acted improperly or dishonestly; or
Attempts to interfere with the operation of the Prize Draw.
12.2 The Promoters may cancel, suspend or amend a Prize Draw where necessary due to technical issues, fraud, legal requirements or circumstances beyond their reasonable control.
13. Limitation of Liability
13.1 The Promoters, nor any of their partners, affiliates, agents, employees, officers, directors or representatives will be liable (to the fullest extent permitted by law) for any direct, indirect or consequential loss or damage arising out of the organising or holding of the Prize Draw or as a result of any entrant’s participation in the Prize Draw or as a result of winning, collecting, use or enjoyment of any prize, if the Prize Draw does not run as planned or if any part of any Prize is unable to be delivered for any reason. Entrants’ statutory rights are not affected.
13.2 If any Prize Draw or any part of it is not capable of running or being completed as planned for any reason, including but not limited to reasons of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the control the Promoters, the Promoters reserve the right to cancel, terminate, modify or suspend the Prize Draw without liability.
13.3 The Promoters do not accept responsibility for Prize Draw entries that are not successfully completed or submitted, regardless of cause, including (without limitation) due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure, of any kind.
14. Severability
14.1 If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
15. Governing Law
15.1 These Terms and Conditions shall be governed by the laws of England and Wales. To the extent permitted by applicable law, any disputes arising from or in connection with these Terms and Conditions shall be subject to the jurisdiction of the courts of England and Wales.
15. Third Party Rights
15.1 Google LLC and Apple Inc. and their respective affiliates may rely on and enforce any provision of these Terms and Conditions that is expressed to be, or is, for their benefit under the Contracts (Rights of Third Parties) Act 1999. Save as set out in this clause, a person who is not a party to these Terms and Conditions has no right under that Act to enforce any of its terms.
15.2 The consent of any third party is not required to vary or rescind these Terms and Conditions.
